A. Consideration of approval of (second reading) of an ordinance providing for the zoning reclassification of all and a portion of parcels of real estate in the First Ward of the City of Morgantown from I-1, Industrial District to B-2, Service Business District by amending article 1331 of the planning and zoning code of the City of Morgantown as shown on the exhibit hereto attached and declared to be a part of this ordinance as if the same were fully set forth herein (First reading March 5, 2019).
  • This consideration would change an area of the First Ward from zoning code I-1, Industrial District to zoning code B-2, Service Business District. This change will accommodate for existing businesses and future businesses. (Passed 6-0)
B. Consideration of approval of (second reading) of an ordinance amending article 1743 "Floodplain Ordinance" (First reading March 19, 2019). 
  • Revisions of this ordinance would bring the city into compliance with the National Flood Insurance Program and West Virginia Department of Homeland Security Requirements. Change in the Floodplain Ordinance may allow for residents who currently have flood insurance to no longer need it or to have lower rates, or those who have not needed it may now need it. For more information contact the Engineering Department. (Passed 6-0)

  • Jerry Cochran asked for a delay in voting on the River Road ordinance rate change. He spoke about his concerns regarding the waterworks rates on River Road.

Consent Agenda 
  • Items in the consent agenda were moved to new business. 
New Business
  • Asset purchase agreement - City of Morgantown, Morgantown Utility Board and River Road Public Service District. 
    • This would allow the City of Morgantown and the Morgantown Utility Board to purchase the assets of the waterworks system of River Road Public Service District. (Passed 5-1)
  • Bond ordinance - assumption, and re-designation, of the River Road Public Service District's water revenue bond. 
    • This ordinance would re-designate the River Road Public Service District's water revenue bond to the Morgantown Utility Board. (Passed 5-1)
  • Ordinance authorizing the acquisition of the assets of the waterworks system of the River Road Public Service District and approving an acquisition agreement by and among River Road Public Service District, the City of Morgantown, and the Morgantown Utility Board.
    • This ordinance would approve of the acquisition of the waterworks system of River Road Public Service District by the Morgantown Utility Board. (Passed 5-1)
  • Consideration of approval of (first reading) of an ordinance setting forth the rates, fees and charges for service to customers of the waterworks system of the City of Morgantown.
    • This ordinance would not change the charges that are already in place to customers of the waterworks system of the City of Morgantown. This ordinance would add an addition to where specific rates apply. (Passed 5-1)
  • Consideration of approval of (first reading) of an ordinance authorizing sale of real estate near the Morgantown Municipal Airport. 
    • This ordinance would allow the City Manager to execute the sale of parcels 9 and 13 tax map 32A near the Morgantown Municipal Airport. This ordinance is subject to approval by the Federal Aviation Administration. This ordinance was tabled by consent of the council.
  • Consideration of approval of (first reading) of an ordinance annuling a portion of Beverly Alleyway and providing for dedication of additional public right-of-way to Beverly Alley. 
    • This ordinance would annul portions of Beverly Alleyway to allow for physical improvements along Beverly Avenue. (Passed 6-0)
City Manager's Report

Information 
New Business
  • Award bid for airport towing tractor, bid call 2019-02. 
    • City Manager Paul Brake recommended that the airport towing tractor bid be awarded to Aero Specialties Ground Support Equipment in the amount of $94,576.87. This is included in the Capital Escrow Fund. (Approved 6-0)

City Clerk's Report 
  • City Clerk Christine Wade spoke about the upcoming city election on April 30. For more information visit the city website. 
    • The last day to register to vote is April 9.
    • April 12 at 10 a.m. the public test of the voting machines will take place in Council Chambers. The event is open to the public and will be televised on Channel 15. 
    • Absentee Ballots are ready to be sent to those who requested an absentee ballot. The last day to apply for an absentee ballot is April 16.
    • The last day to file a write-in certificate of announcement is April 16. 
    • Early voting is April 17-27. Early voting is for everyone. 
    • All candidates are listed on the website. 
  • Entry level police officer testing is April 13. 
  • Christine Wallace encouraged citizens to sign up for the Notify Me program on the city website
