Andrew's* Story
As a 6-year-old diagnosed with Autism, Andrew* has an Individualized Education Plan (IEP) – a written statement of the education program designed to meet his individual needs, mandatory for every child who receives special education services. Under his IEP, Andrew is entitled to receive three thirty-minute speech therapy sessions each week during the school day.

The elementary school where Andrew attends kindergarten did not have a speech therapist on staff for the first three months of the school year, and during this time, he missed 35 sessions of speech therapy. Andrew's father noticed that Andrew was beginning to lose his ability to identify letters and objects – tasks that he was able to complete after working consistently with a speech therapist during preschool. Andrew’s father repeatedly went to the school district to ask what they were going to do about his son’s missed speech therapies. When the issue was still not resolved, he came to Legal Services of the Hudson Valley for assistance.

Andrew's attorney sent a demand letter to the school district that explained that the school’s inability to provide Andrew with speech therapy for the first three months of the school year constituted a failure to provide a free and appropriate education under the Individuals with Disabilities Education Act (IDEA), and therefore was a violation of Andrew’s rights. As a result, the school agreed to make up for those lost speech therapy sessions during the summer so that Andrew could regain the skills he lost and progress in his education.

In 2015, the attorneys and staff of Legal Services of the Hudson Valley:
• Provided representation or legal advice to 398 children involving 425 legal matters, which impacted 1,474 household and family members.
• Of the 425 legal matters handled, (44%) involved education issues.
